Terms of use

These terms of use apply to all users of Westport Harbour’s services. If you use our port services, it will be assumed that you have agreed to these terms, without qualification.

INFORMATION AND PRIVACY

You hereby authorise the port to receive and collect information about you (including information about your online transactions) from time to time through the port website. Any such information collected will be treated in accordance with our privacy policy. The port may only disclose information about you (including your identity) to a third party if the port is requested to do so in the course of a criminal or other legal investigation, if you have authorised such disclosure, or if the port determines that disclosure is necessary in connection with any complaint regarding your use of the site. 

SECURITY

Online transactions are provided through a secure third-party website. However, you acknowledge and agree that internet transmissions are never entirely secure or private, and that any message or information you send to or through the port website.

The port shall have no liability for the interception or 'hacking' of any data through the port website or any other website by unauthorised third parties.

LIMITATION OF LIABILITY

Except as expressly prohibited by law, in no event will the port be liable to you for any direct, indirect, consequential, exemplary, incidental or punitive damages, including lost profits, even where the port has been advised of the possibility of such damages occurring. If, notwithstanding the foregoing, the port is found to be liable to you for any damage or loss which arises as a result of your use of the website, the port's liability shall not exceed the dollar amount of the transaction that formed the basis of the damage or $100.00, whichever is the lesser.

RIGHT TO SUSPEND, ALTER OR CANCEL SERVICE

The port shall be entitled at any time, without prior notice or any liability to you, to cancel or suspend any or all online services and/or to substitute alternative services, which may or may not be interactive or transactional in nature.

SPECIFIC SERVICE TERMS AND CONDITIONS

The Customer acknowledges that certain online transactions made available or offered by the port from time to time may be subject to specific additional terms and conditions, and agrees to review and comply with any such additional terms and conditions. Access and use of any online service shall be deemed to constitute acceptance of any such additional terms and conditions applicable to such service.
